This Privacy Policy describes how TX Fitness (“TX Fitness,” “we,” “us,” or “our”) collects, uses, and protects your information when you visit our gym, use our website, or sign up for a membership, free trial, or other services (collectively, the “Services”). It also explains the choices you have about your information.

1. Information We Collect

When you contact us, sign up, or use our Services, we may collect:

  • Contact information — name, email address, phone number, and mailing address.
  • Membership details — date of birth, emergency contact, plan status, and waiver/consent records.
  • Payment information — card or bank details are tokenized by our payment processor. We do not store raw card or bank numbers on our servers.
  • Membership activity — check-ins, class attendance, billing history, and communications with us.
  • Device and usage data — IP address, browser type, pages visited, and similar technical information collected through standard server logs and cookies.

2. How We Use Your Information

  • Provide, maintain, and improve the Services, including gym access and membership management.
  • Process payments, dues, refunds, and other transactions.
  • Send transactional communications (receipts, billing notices, account alerts, class changes, trial reminders).
  • With your consent, send marketing communications about promotions, events, and gym updates.
  • Prevent fraud, enforce our terms, and comply with legal obligations.

3. SMS / Text Messaging

If you opt in to text messages, we may send you marketing and transactional SMS messages at the phone number you provided, including class reminders, billing notices, trial expiration reminders, promotions, and gym updates. Consent to receive SMS messages is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply STOP at any time to unsubscribe or HELP for help. You may also email us at info@tx.fitness to opt out.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as our CRM and messaging provider, is permitted solely to deliver the messages you have requested. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. How We Share Information

We share personal information only with service providers who help us operate the Services, and only to the extent needed to perform their work. These providers are contractually required to safeguard your information and use it solely on our behalf. They include:

  • GoHighLevel (HighLevel, Inc.) — CRM, marketing automation, and delivery of transactional and marketing SMS and email on our behalf.
  • Our payment processor — payment processing and recurring billing.
  • Analytics tools — Google Analytics and the Meta Pixel, used to measure website traffic and advertising performance in aggregate.

We may also disclose information when required by law, to respond to valid legal process, or to protect the rights, property, or safety of TX Fitness, our members, or others. We do not sell your personal information.

5. Cookies and Similar Technologies

We use cookies and similar technologies to remember your preferences and understand how the Services are used. You can control cookies through your browser settings; disabling them may affect functionality.

6. Data Retention and Security

We retain personal information for as long as needed to provide the Services, resolve disputes, meet tax and accounting obligations, and enforce our agreements. We use industry-standard technical and organizational safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your Rights and Choices

  • Access, correct, or update the information we hold about you.
  • Request deletion of your information, subject to legal and accounting retention requirements.
  • Opt out of marketing emails by using the unsubscribe link in any marketing email.
  • Opt out of SMS messages by replying STOP.

8. Children

Our website is intended for adults. We do not knowingly collect personal information online from children under 13. If you believe a child has provided us with personal information through our website, please contact us so we can delete it.
